By creating an account on Diwigo, you accept the rules that follow. They are written to be understood, not to be circumvented.

Who publishes Diwigo

Diwigo is published and operated by Dukiwi SA, a Swiss company based in Estavayer-le-Lac. These terms form the contract between you and Dukiwi SA.

Accepting these terms

By creating an account and using Diwigo, you accept these terms and the privacy policy. If one of them does not suit you, the consequence is simple and taken in good part: do not use the service.

Purpose of the service

Diwigo is a social network described as “anti-passivity”: it encourages you to actively maintain the bond with the people close to you rather than to scroll through an endless feed. The service is provided free of charge, as is, and its content may change.

Who can open an account

Access to Diwigo is subject to the following conditions:

• Registration is by invitation: a valid activation code is required. Each member has a limited number of invitations.
• You must be at least thirteen. Under eighteen, your account can only be created on the invitation of an adult who is already a member, and who becomes responsible for it: they see what you post and what you like, your account is not public and cannot be followed.
• The information you provide when registering must be accurate and kept up to date.
• One account per person. Automated accounts and bots are not allowed.

Your account's security

You are responsible for keeping your password confidential and for the activities carried out from your account. Choose a unique password and enable two-factor authentication: it is the best protection available. Let us know immediately in the event of unauthorised use.

Rules of conduct

Diwigo is built on trust. The following are prohibited:

• Any illegal content, as well as incitement to hatred, violence or discrimination.
• Harassment, threats, intimidation and abusive remarks aimed at a person.
• Publishing private information about other people without their consent, including photos, contact details and addresses.
• Spam, unsolicited advertising and the use of invitations for commercial purposes.
• Any attempt to bypass the site's protections, to access accounts or content that are not intended for you, or to disrupt how it works.
• Impersonating another person or organisation.

Your content

What you post belongs to you. We claim no ownership over your texts, photos and videos.

You grant us only the technical permission necessary to store your content and display it to the people you have chosen. This permission ends when you delete the content or your account.

You remain responsible for what you post and warrant that you hold the necessary rights to the content you upload.

Visibility and circles

You choose, for each post and for each piece of profile information, who can see it. Keep in mind, however, that a person allowed to see a piece of content can technically copy it or share it further: never post what you could not stand behind outside the site.

Invitations

Each member receives a limited number of invitation codes, which are personal and may not be sold. By inviting someone, you automatically enter into a relationship with them. You are required to invite only people you genuinely know.

Service availability

We do our best to keep Diwigo available, without guaranteeing uninterrupted availability. The service may be suspended for maintenance, updated or modified, and some features may change or disappear.

Suspension of an account

We may suspend or delete an account that breaches these terms, puts other members at risk or compromises the security of the service. Except in an emergency or where required by law, we first set out the reason to you and give you the opportunity to respond.

Closing your account

You can request the deletion of your account at any time by writing to info@diwigo.com. Your personal data and your content are then erased, under the conditions described in the privacy policy.

Liability

Diwigo is provided free of charge and as is. To the extent permitted by law, we cannot be held liable for the content published by members, nor for indirect damages related to the use of the service. Nothing in these terms limits our liability in the event of gross negligence or wilful misconduct.

Changes to the terms

These terms may change. In the event of a significant change, we will inform you on the site or by e-mail before it takes effect. Continuing to use Diwigo after that date constitutes acceptance of the new terms.

Governing law

These terms are governed by Swiss law. In the event of a dispute, and failing an amicable settlement, the courts of the canton of Fribourg have jurisdiction, subject to mandatory provisions protecting consumers.
